Terms & Conditions

Definitions
In these definitions the following terms shall have the following meanings

'Gift Garden' shall mean the Gift Garden website, a subsidiary of Mr Gamemaker Limited.
'The Customer' shall mean the party whose name and address appears in our database connected to an order
'Goods' shall mean any item described for sale on this web site.

Title

Title to any goods supplied to the customer by Gift Garden shall remain the property of Gift Garden until such a time that payment has been made in full by the customer.

Payment

Credit/Debit Cards

Payment may be made by credit card or debit card via our Shopping Cart using the Metacharge secure transaction server.

Cheques

You can also pay by cheque by posting a cheque made out to 'Mr Gamemaker Ltd'. Cheque payments can only be accepted in Pounds Sterling (GBP). Please note that goods will NOT be dispatched until the cheque has been cleared.

Sterling Postal Orders
We also accept payment by Postal Orders. Postal Orders must be crossed and made payable to 'Mr Gamemaker Ltd'.

Gift Garden will provide a receipt for all payments. For credit or debit card purchases, a reciept will also be dispatched instantly by email by our automated system.

Handling and Shipping

Gift Garden will endeavour to dispatch goods as quickly as possible from the date of receipt of the order for Credit/Debit card and postal orders. For cheque payments, goods will not be dispatched until the cheque has cleared. As the Gift Garden dispatches goods from many different suppliers from many different locations across the U.K, the dispatch time varies depending on the types of products purchased. When you visit the Gift Carden shopping cart screen, you will see the products in your cart broken down into shipping groups (these are basically groups of products that ship from different locations) and you will be given information on when these groups of products are likely to be shipped.

All goods will be dispatched to the delivery address on the order. If the goods are not in stock, or if there is any delay then the customer will be notified by e-mail using the e-mail address supplied by the customer on the order. If payment has been made by Cheque or Postal Order and no contact information was supplied by the customer the order will not be fulfilled.

Gift Garden may list some items on its website as pre-order items. These are items that the manufacturer has not yet made, or we have not yet received. These pre-order items do not have a firm delivery date but we usually know the approximate time of arrival. We take pre-orders to allow customers to reserve these goods, and will supply them as soon as they are available. We will not make any charge to the customer until we dispatch the goods. The customer may cancel the order without charge at any time up until the item(s) is shipped.

Postage Tariffs
Gift Garden will charge the postage costs using the figure quoted at the Shopping Cart/Checkout and stored on the order. If you are paying by either cheque or postal order you can still use the shopping cart system to evaluate your total commitment to us. You should only proceed to the checkout screen however if you intend to pay by either Credit or Debit card.

If the customer has selected the wrong shipping tarrif (for instance requested UK postage for overseas delivery) then the order will not be fulfilled and the transaction will be cancelled. Gift Garden will contact the customer to inform them that the order has been cancelled so that the customer can repeat the purchase with the correct shipping tariff. Currently, Gift Garden only provides shipping to U.K locations via this website. If you would like to place an international order then you should submit a support ticket using our help desk where you will be advised by one of our customer support team on how to proceed.

Returning Goods

All goods sold from this website are believed to be of merchantable quality. If, however, you should receive a faulty item the following procedures should be followed:-

1) Please e-mail us within 21 days of the delivery, giving details of any problem, this is to speed up any refund process.

2)We will contact you and agree a resolution to the problem. This would be either a full refund including postage, a replacement item, or any other mutually agreed resolution. This does not affect your statutory rights. A full refund is always offered for faulty goods.

3)Where Gift Garden requests the return of a faulty item, then Gift Garden will refund any postage incurred.

Please do not send back faulty goods without contacting us first. It speeds up the process if we have prior knowledge of a problem. If you do send goods back to us without prior notification, please remember to include details of who you are, and what your complaint is along with your invoice number.

Cancelling Orders

The Customer can cancel an order at any time before we dispatch the goods and Gift Garden will issue a FULL refund if the customer has already been charged at that point.

After receipt of the goods the customer again has a two week cooling off period in which they can cancel the order and get a full refund. The customer must however keep the goods in good order so that they remain in a saleable condition. For many products (especially those in bubble or blister packs) this means they must remain sealed in their blister packs. This reflects what you can do in a shop as certain products are unsaleable if they are removed from their blister pack as there is no way in which this can be done without tearing the pack.

If you cancel the order after receiving the goods, then we require that you send the goods back in good order at your cost.

Order acceptance

The completion of the contract between the Customer and Gift Garden will take place on the dispatch of the products to the Customer unless Gift Garden have notified the Customer that Gift Garden does not accept the order or the Customer has cancelled it in accordance with the instructions described above in 'Cancelling Orders'.

Gift Garden reserves the right to refuse or reject any order for whatever reason.

Complaints

If you have any complaints regarding any part of our service, please address them to support@giftgarden.co.uk.

All complaints are treated very seriously, as we want to provide as good a service as possible. On receipt of a complaint a senior company officer will respond within 2 working days, acknowledging receipt of the complaint and giving an indication what we will do to try and resolve the problem and where possible provide a timescale for this resolution.

All complaints will be treated confidentially.

Statutory Rights
Nothing in this contract affects your Statutory Rights.
